Data Monster Marketplace Refund & Returns Policy
Data Monster, Inc. (“Data Monster”), operating the CallCentersForHire.com marketplace (“Marketplace”), provides a platform that connects buyers with independent vendors, agencies, freelancers, service providers, and digital product sellers.
Data Monster operates as a marketplace and transaction facilitator. Data Monster is not the manufacturer, owner, or direct provider of most products and services listed by marketplace sellers.
Refund eligibility depends on the type of purchase, the applicable seller terms, the status of delivery, buyer approval, escrow status, and applicable laws.
Our Role as a Marketplace
Data Monster provides:
- A marketplace platform connecting buyers and sellers.
- Payment processing and escrow services where applicable.
- Communication tools between buyers and sellers.
- Marketplace support and dispute assistance.
- Transaction monitoring and escrow release procedures.
Unless expressly stated otherwise in a listing, Data Monster is not the seller, supplier, manufacturer, or service provider of marketplace products and services.
Individual sellers are responsible for fulfilling orders and delivering products or services as described in their marketplace listings.
Marketplace Product Categories
The Data Monster Marketplace currently focuses on digital products and professional services.
Marketplace offerings may include, but are not limited to:
- Website design and development
- Logo and graphic design
- SEO and digital marketing services
- AI and automation services
- Call center and BPO services
- Lead generation and live transfer services
- Data services
- Software and SaaS solutions
- Consulting services
- Freelance services
- Other digital products and business services
Data Monster does not currently offer physical products for sale through the Marketplace.
If physical products are introduced in the future, the physical product return policy below will apply unless a seller provides a more favorable return policy within their product listing.
Digital Product Refund Policy
Digital products are generally considered final sale items because they cannot be physically returned once access or delivery has occurred.
Digital products include, but are not limited to:
- Digital files
- Software access
- Downloads
- Online resources
- Digital assets
- Templates
- Other electronically delivered products
Refunds for digital products may be considered if:
- The incorrect product was delivered.
- The product was not delivered.
- The product is materially different from the listing description.
- The seller agrees to issue a refund.
- Fraud or unauthorized payment is confirmed.
- A refund is required under applicable law.
Refunds are generally not available after:
- Digital access has been provided.
- Files have been downloaded or delivered.
- Buyer approval has been provided.
- Escrow funds have been released.
Professional Services Refund Policy
Professional services offered through the Marketplace may include:
- Website development
- Logo design
- Marketing services
- SEO services
- AI services
- Consulting
- Call center services
- BPO services
- Lead generation
- Live transfer services
- Custom freelance services
Because professional services are customized and require time, labor, and resources, they generally cannot be returned once work has started.
Refunds may be considered when:
- Services have not yet begun.
- The seller agrees to issue a refund.
- A dispute is resolved in favor of the buyer.
- Escrow funds have not yet been released.
- Applicable law requires a refund.
Completed services, completed milestones, or work approved by the buyer are generally considered final.
Escrow Transactions
Certain transactions on the Data Monster Marketplace may use escrow protection.
When escrow is used:
- Buyer funds are held securely during the transaction period.
- Sellers complete delivery according to the marketplace agreement.
- Buyers have an opportunity to review and approve delivered products or services.
- Funds are released after buyer approval or according to the applicable escrow terms.
Buyers should inspect all products and services before approving delivery.
Once:
- The buyer approves delivery, and
- Escrow funds have been released,
the transaction is generally considered completed and is not eligible for refund unless fraud, a material issue, or legal requirements apply.
Buyer Responsibilities
Buyers are responsible for:
- Reviewing product and service descriptions before purchase.
- Understanding seller terms before completing an order.
- Asking questions before purchasing when clarification is needed.
- Reviewing delivered products or services before approval.
- Reporting issues promptly.
- Following applicable inspection and dispute timelines.
Failure to report concerns before approving delivery may limit refund eligibility.
Seller Responsibilities
Marketplace sellers agree to:
- Provide accurate descriptions of products and services.
- Deliver products and services as described.
- Communicate with buyers in good faith.
- Cooperate during disputes.
- Honor any additional refund terms stated in their listing.
A seller may provide a refund policy that is more favorable than this Marketplace policy. If so, the seller’s published refund policy will apply.
Physical Product Return Policy (Future Marketplace Category)
The Data Monster Marketplace does not currently offer physical products for sale. This section will become effective if physical products are introduced.
Unless an individual seller provides different terms, eligible physical products may be returned under the following conditions:
Return Window
Physical products may be returned within 14 calendar days of delivery.
Return Requirements
Returned products must:
- Be new, unused, and in resalable condition.
- Be returned with the original packaging.
- Include all accessories, manuals, documentation, tags, and included materials.
- Be free from damage caused after delivery.
- Include proof of purchase or order confirmation.
Items that are used, damaged, altered, incomplete, or missing original packaging may not qualify for a refund.
Return Shipping
The buyer is responsible for return shipping costs unless:
- The wrong product was shipped.
- The product arrived defective.
- The product arrived damaged.
- The return is due to a seller error.
Buyers should use a trackable shipping method and retain proof of shipment.
Refund Processing
Once the returned product has been received and inspected, approved refunds will be issued to the original payment method.
Refunds will generally be processed within 10 business days after approval, although final posting times may vary depending on the buyer’s financial institution or payment provider.
Original shipping charges are generally non-refundable unless required by law or caused by seller error.
Non-Returnable Physical Products
Returns are generally not accepted for:
- Used products.
- Damaged products caused after delivery.
- Products missing original packaging or components.
- Personalized or customized products.
- Clearance or final-sale items clearly marked as non-returnable.
Change of Mind Returns
Returns due solely to buyer change of mind, buyer’s remorse, accidental purchase, ordering the wrong product, or no longer wanting the item are not accepted, unless the seller specifically offers such returns in the product listing.
Chargebacks
Buyers are encouraged to contact Data Monster before initiating a chargeback with a payment provider.
Our support team will make reasonable efforts to assist in resolving marketplace disputes before a payment dispute is filed.
Fraudulent or abusive chargebacks may result in account restrictions or termination.
Dispute Resolution
For eligible marketplace transactions, Data Monster may assist with dispute resolution between buyers and sellers.
Documentation that may be reviewed includes:
- Marketplace messages
- Agreements
- Order details
- Screenshots
- Files delivered
- Proof of service completion
- Delivery confirmations
- Other relevant transaction information
Dispute decisions are based on available evidence, marketplace policies, seller terms, and applicable agreements.
